State law prohibits discrimination of cannabis use for new school applicants

DAYTON–The Dayton School Board considered implementing a new RCW for new-hire applicants and discussed a work-based credit program for high school students at the work session held on January 3.

The board is considering a change to the personnel policy for new-hire applicants, in accordance with RCW 49.44.420, which states if a district requires drug screening for pre-employment, the district cannot discriminate against someone who tests positive for cannabis. "The legislature passed it, so it is a required policy, but I would be watching very closely," said Interim Superintendent Rich Stewart. "I have talked to lawyers and risk management who believe this one will go through an appeal process."

Currently, the school does not require pre-employment drug screening. School bus drivers are exempt and must adhere to federal regulations, federal funding, and CDL requirements. Presently, this pending change does not interfere with the school district's disciplinary policies for current employees.

The board reviewed policies related to graduation requirements, and is looking to add Policy 2401-titled Financial Education Mastery-Based Learning and Credit. This curriculum will provide an opportunity for high school students to work and earn elective credits towards their graduation goals.

"We have students who can graduate, but prefer to work and this gives them the motivation to continue graduating, gets them work experience, and hopefully go on to get additional training in their chosen career," said Stewart. If approved, the policy will be implemented for the 2024-25 school year.

In other business, the board continues plans for the new superintendent interview process, and approved the hire of Landon Callas as a full-time night custodian.
